Notice and Procedure for Making Claims of Copyright Infringement

Vital Carry strives to respect intellectual property rights and will not knowingly post content that infringes the copyrights of others. Vital Carry tries it's best to vet all material. We hate infringers just as much as you do. Accordingly, and pursuant to the Digital Millennium Copyright Act (17 U.S.C. §512(c)), Vital Carry has designated an agent to receive notifications of alleged copyright infringement on the Website (the "Copyright Agent"). If you believe that your work has been used in a way that constitutes copyright infringement, please send a written communication to the Copyright Agent that contains the following ("Notification"):
  • A description of the allegedly infringed work,
  • A description of the location of the allegedly infringing work on the Website, including the URL,
  • Your name, mailing address, email address, and telephone number,
  • A statement by you that you have a good faith belief that the disputed use is unauthorized under current law,
  • A statement by you that you believe, under penalty of perjury, that your allegations are true and that you are the copyright owner or acting on behalf of the copyright owner, and
  • Your physical or electronic signature.
Upon receipt of a Notification, Vital Carry will remove or disable access to the allegedly infringing material and promptly notify and advise the alleged infringer regarding the counter notification procedures. Vital Carry reserves the right to terminate the accounts of repeat infringers.

Counter Notification Procedures

If you believe your copyrighted material was mistakenly removed from the Website, you may submit a Counter Notification to the Copyright Agent listed below pursuant to 17 U.S.C. § 512(g)(2) and (3). The Counter Notification must include:
  • Identification of the material that was removed or disabled due to mistake or misidentification and the location where the material appeared before it was removed or disabled,
  • A statement that you consent to the jurisdiction of the federal District Court in which your mailing address is located, or if your mailing address is located outside of the United States, you consent to the jurisdiction of the U.S. District Court for the Southern District of New York, Manhattan Division,
  • A statement that you will accept service of process from the party that filed the Notification or the party's agent,
  • Your name, mailing address, email address, and telephone number,
  • A statement that you have a good faith belief, under penalty of perjury, that the material in question was removed or disabled due to a mistake or misidentification, and your physical or electronic signature.
If you comply with the Counter Notification procedures identified above, Vital Carry will restore your removed or disabled material after ten (10) business days but no later than fourteen (14) business days from the date Vital Carry receives the Counter Notification, unless Vital Carry first receives notice from the person who submitted the Notification that such person has filed an action seeking a court order to restrain your activity related to the removed or disabled material.
